Terms & Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE SERVICES.

BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.

 

1. Eligibility and Use

The Services are intended for use by parents or legal guardians (“Adult Users”) and their children.

By using the Services, you represent and warrant that:

  • You are at least 18 years old
  • You are the parent or legal guardian of any child using the Services
  • You are responsible for all activity conducted under your account

Children may only use the Services under the supervision and control of an Adult User.

 

2. Account Registration and Access

To use the Services:

  • You must create an account by providing your email address or by using a supported third-party authentication provider (such as Google, Apple or Facebook)
  • If you choose to register or log in using a third-party authentication provider, you acknowledge that your use of such services is subject to that provider’s terms and privacy practices, and we are not responsible for those services.
  • You must complete any required verification steps, including one-time password (OTP) verification where applicable, before accessing certain features of the Services.
  • No child data is collected prior to successful completion of required verification.

OTP verification is required:

  • When creating an account
  • When resetting a password

You are responsible for:

  • Maintaining account security
  • All activity under your account

Accounts:

  • May not be shared across multiple households
  • May not be used simultaneously across multiple devices

 

3. Subscription and Billing

The Services offer paid subscription plans, including:

  • Basic Plan (limited features and usage)
  • Premium Plan (expanded features and usage)
  • Lifetime Plan (one-time purchase)

Billing Options

Subscription plans may be offered on different billing frequencies, including:

  • Weekly
  • Monthly
  • Yearly

Certain plans (such as yearly subscriptions) may include a free trial period (e.g., 3 days), if offered at the time of purchase.

Billing and Renewal

  • All purchases are processed through the Apple App Store or Google Play Store
  • You authorize the applicable platform to charge your payment method
  • Subscriptions automatically renew at the selected billing frequency unless canceled

Cancellation

  • Subscriptions must be canceled through your Apple or Google account settings
  • Cancellation will prevent future billing
  • Access will continue until the end of the current billing period unless the account is deleted

Account Deletion and Subscription Cancellation

If you delete your account:

  • Your subscription will be immediately canceled
  • Your access to the Services will end immediately
  • You will not retain access for any remaining billing period

Refunds, if any, are handled:

  • In accordance with Apple or Google policies
  • Or on a case-by-case basis at our discretion

 

4. Description of Services

Calling All Kids provides a parenting support tool that enables parents to create interactive, personalized call experiences for their children.

The Services:

  • Combine scripted and AI-generated content
  • Are designed to support parenting goals
  • Are not a substitute for any medical, psychological, educational, or other professional advice

Important Disclaimer

The Services:

  • Are not medical, psychological, or educational advice
  • Do not guarantee behavioral outcomes
  • May include automated responses that are not always accurate

You are responsible for supervising your child’s use of the Services.

 

5. Voice, Transcription, and AI

  • Voice input is processed in real time and not stored
  • Speech may be converted into text
  • Sensitive information is automatically filtered and redacted

Transcriptions:

  • Are used for functionality and internal analytics only
  • Are not used to train external AI models

AI-generated responses:

  • May be imperfect or contain errors
  • Should not be relied upon as authoritative guidance

 

6. Photos and User Content

Parents may choose to upload photos of their children to personalize the Services.

By uploading a photo, you represent and warrant that you have the legal right to provide that image.

Photos are used solely to support the functionality of the Services and are not shared with other users or made publicly available.

Photos:

  • Are stored securely (e.g., AWS S3)
  • May be processed by trusted third-party service providers (such as background removal tools) solely to support app functionality
  • Are not used for facial recognition, biometric identification, or profiling

Photos are treated as personal data and handled in accordance with our Privacy Policy.

User Content Restrictions

You agree not to upload or submit content that:

  • Is unlawful, harmful, or abusive
  • Violates privacy or intellectual property rights
  • Contains sensitive personal information

 

7. Acceptable Use

You agree NOT to:

  • Attempt to reverse engineer or manipulate the Services
  • Attempt to extract system prompts or exploit AI behavior
  • Use the Services for commercial purposes
  • Upload harmful, illegal, or inappropriate content
  • Interfere with system security

We reserve the right to suspend or terminate accounts for violations of these Terms.

We also reserve the right to investigate suspected misuse of the Services and, where appropriate, cooperate with law enforcement authorities and report unlawful activity.

 

8. External Links and Sharing

  • External links are protected by a parental gate
  • The Services may include a “Share with Friends” feature

You are responsible for how you share content externally.

We are not responsible for third-party services accessed through shared links.

 

9. Account Termination

You may delete your account at any time.

Upon deletion:

  • Access is immediately revoked
  • Personal data is deleted in accordance with our Privacy Policy

We may suspend or terminate accounts for:

  • Abuse
  • Misuse
  • Fraud
  • Violations of these Terms

If you delete your account, your subscription will be immediately canceled and your access to the Services will end at that time. You will not retain access to the Services for any remaining portion of your subscription period. Any refunds will be handled in accordance with applicable app store policies or on a case-by-case basis at our discretion.

 

10. Intellectual Property

All content within the Services is owned by Calling All Kids.

You are granted a limited, non-transferable license to use the Services for personal use only.

You may not:

  • Copy, distribute, or modify content
  • Use the Services for commercial purposes

 

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

We make no guarantees regarding:

  • Accuracy
  • Reliability
  • Availability
  • Performance

We do not guarantee that the Services will be uninterrupted, error-free, or available at all times.

 

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for:

  • Indirect or consequential damages
  • Loss of data
  • Behavioral outcomes

To the fullest extent permitted by applicable law, total liability is limited to the amount paid by you in the 12 months immediately preceding the claim.

 

13. Indemnification

You agree to indemnify and hold harmless Calling All Kids from any claims arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your uploaded content

 

14. Arbitration and Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You and Calling All Kids agree that any dispute, claim, or controversy arising out of or relating to the Services or these Terms (each, a “Dispute”) will be resolved through binding arbitration on an individual basis, except as otherwise provided below.

A. Agreement to Arbitrate

To the fullest extent permitted by applicable law:

  • Any Dispute will be resolved exclusively through final and binding arbitration
  • You waive the right to bring claims in court
  • You waive the right to a trial by jury
  • You waive the right to participate in a class action or representative proceeding

B. Informal Resolution First

Before initiating arbitration, both parties agree to attempt to resolve the Dispute informally.

  • You must send a written notice describing the Dispute and proposed resolution
  • We will attempt to resolve the issue within 30 days

C. Arbitration Process

If the Dispute is not resolved informally:

  • Arbitration will be administered by the American Arbitration Association (AAA) or another mutually agreed provider
  • The arbitration will be conducted by a single neutral arbitrator
  • The arbitration will follow the applicable rules of the arbitration provider
  • The arbitrator’s decision will be final and binding

D. Location

  • Arbitration will take place in the United States
  • If an in-person hearing is required, it will occur in the metropolitan area where you reside

E. Exceptions

This arbitration agreement does NOT apply to:

  • Claims that may be brought in small claims court
  • Claims seeking injunctive or equitable relief related to:
  • Intellectual property
  • Unauthorized access to or misuse of the Services

F. No Class Actions

You and Calling All Kids agree that:

  • All Disputes must be brought in an individual capacity
  • Class actions, consolidated actions, and representative proceedings are not permitted

G. Opt-Out Right

You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms.

Your notice must include:

  • Your name
  • Your address
  • A clear statement that you wish to opt out of arbitration

H. Survival

This section will survive termination of your account and your use of the Services.

I. Governing Law

This arbitration agreement is governed by the Federal Arbitration Act and applicable United States law.

 

15. International Use

The Services are operated from the United States.

If you access the Services from outside the U.S., you are responsible for compliance with local laws.

 

16. Updates to Terms

We may update these Terms from time to time in our sole discretion. Updated Terms will be effective upon posting. Where required by applicable law, we may provide notice of material changes through the Services or by other reasonable means. Your continued use of the Services after such updates constitutes your acceptance of the updated Terms.
